Where is the line between free speech and hate speech?

Harry Miller, a businessman and former police officer was contacted by the police over a limerick he re-tweeted, which the police deemed a hate incident. The police admitted that no crime was committed but Mr Miller's tweets were being monitored after they received complaints about 30 or more offensive tweets about transgenderism. The High Court has granted permission for him to challenge the National College of Policing´s guidance on ‘hate incidents’ against transgender people. The Today programme spoke to Harry Miller in first interview about this.
