Should lesbian parents be treated as a family like any other? Should a sperm donor have the right to custody? There's no doubt that modern developments like IVF and the increase of gay parenting has had a radical impact on child rearing with important implications for family law.
This week a case in Scotland has sparked off a national debate. A gay man who acted as sperm donor for a lesbian couple has been awarded full parental rights and responsibilities. The judge ruled that a lesbian couple cannot constitute a family unit.
Martha speaks to Alison Clelland, convenor of the Scottish Child Law Centre about how the situation differs from that in England and Wales.
